This consent form (“Form”) records your consent for processing certain personal data (detailed below) for the purposes (detailed below) in connection with your purchase of our two wheeler vehicles (“Vehicle”) and any associated financing arrangements with financial institutions that provide financing (“Financiers”) and/or their representatives in accordance with this consent and our privacy policy.
In connection with your purchase of the Vehicle and the associated loan arrangement facilitated by the Financier, HMCL may collect, transmit, publicize, store, retain, and use the following categories of personal data;
·Contact Information, such as your name, mobile number, residence, and email address, for the purpose of verifying your identity, seeking consent, and enabling loan-related communications;
·Financial Information, including your income, existing loan etc for the purpose of determining eligibility for pre-approved offers by Financiers.
These categories of personal data may be collected by HMCL and shared with the relevant Financier and/or their representative to whom the Vehicle is linked for the limited purposes outlined below.
A. PURPOSES OF PROCESSING
Your personal data may be processed and shared with the Financier and/or their representatives for, inter alia, the following purposes:
·To validate and associate your identity and eligibility details with a specific loan;
·To enable the Financier and/or their representatives to monitor risk, loan status and compliance with contractual terms; and ·
·To ensure communication regarding your loan status is properly managed via authorized channels.
All such processing shall be done in accordance with applicable law, and only to the extent required for the above purposes and in accordance with our Privacy Policy accessible here.
B. CONSENT
By signing or validating this Form (including via Verification Code (“Code”) sent to your registered mobile number), you confirm your voluntary, specific, and informed consent to the aforesaid, collection, transmission, publication, storage, retention, and any other usage of your personal data, as per our Privacy Policy, and as may be notified to you, from time to time.
Should you not provide your consent, you may not be able to avail financing in relation to your Vehicle.
In the event of a change in applicable data protection law in India, including the implementation of the Digital Personal Data Protection Act, 2023 and the rules thereunder, you expressly consent to HMCL’s continued collection, use, storage, and sharing of your personal data. You agree to provide such additional consents or approvals that may be required under the revised legal framework.
C. TERMS OF USE
These Terms of Use include and incorporate by reference hereto, (as amended and/or supplemented from time to time, the “Terms”), and constitute a legally binding Agreement between you and us. These Terms lay out the terms, conditions and rules which shall be applicable to your present and future access or availing/ use of our services. By registering on or otherwise by accessing or using our services in any manner, you (a) acknowledge that you have read and understood these Terms and consent to become a party to the binding Agreement, (b) represent that you are in compliance with all requirements under these Terms, and (c) agree to be bound by and to comply with this Agreement.
Verification by Code: To complete this consent process, you will be required to enter a Code sent to your registered mobile number. This verification step is intended to confirm your identity and ensure that the consent is being provided by you personally. The Code verification will be time-stamped and stored as part of our consent records.
